Terms of service

Terms of service

Terms of use and service agreement for Kotisivukamu.

1. General

These terms apply to the Kotisivukamu service (hereinafter the “Service”) provided by Kontakto Oy (Business ID: 2831767-5, hereinafter the “Provider”) and to its use. By registering for the Service, the customer accepts these terms.

The Provider reserves the right to change these terms. The customer is notified of changes at least 30 days before they take effect. If the customer does not accept the changes, the customer has the right to terminate the agreement before the changes take effect.

2. Content of the Service

The Service provides the customer with the design, building and maintenance of a website. The Service includes:

  • Building and publishing the website
  • Site maintenance and technical support
  • A domain and an SSL certificate (included in the subscription)
  • Content management through the Kotisivukamu dashboard
  • Visitor analytics and a contact form

The Provider aims to keep the Service available without interruption, but does not guarantee uninterrupted operation. Maintenance breaks are announced in advance where possible.

3. Formation and duration of the agreement

The agreement is formed when the customer registers for the Service and orders a website. The agreement remains in force until further notice, until either party terminates it.

The customer may terminate the agreement at any time. Termination takes effect at the end of the current billing period. The Provider may terminate the agreement with 30 days’ notice.

4. Consumer right of withdrawal

A consumer customer has a 14-day right of withdrawal from the agreement under the Finnish Consumer Protection Act. The right of withdrawal does not apply to a service whose delivery has begun with the customer’s express consent before the end of the withdrawal period. The right of withdrawal does not apply to domain registration.

Withdrawal is made by notifying us by email at tuki@kotisivukamu.fi.

5. Prices and billing

The prices of the Service are set by the price list in force at the time. Prices include value added tax unless otherwise stated.

Billing takes place in advance according to the chosen billing period. If payment is not made within 14 days of the due date, the Provider has the right to close the site. If payment is not made within 30 days, the agreement may be cancelled.

Price changes are announced at least 30 days in advance. The customer has the right to terminate the agreement before a price change takes effect.

The Service includes Kamusaldo, the amount of which depends on the subscription plan. Additional balance can be bought as separate prepayments from the billing view of the dashboard. The terms of Kamusaldo are described separately in section 6.

6. Kamusaldo

Kamusaldo is a prepaid service balance that the customer uses for the AI features of the Service, such as Studio sessions, Kamu chat conversations and AI-assisted site changes. The balance is added to the customer’s team as part of the subscription plan, as a signup bonus and as separately purchased top-ups.

  • Scope of use. Kamusaldo can be used only for features within the Kotisivukamu service. It cannot be exchanged for third-party products or services, and it cannot be used outside the Kotisivukamu service.
  • Not convertible to money. Kamusaldo cannot be converted back into money, and no refund is paid for the balance unless mandatory consumer protection law (for example the right of withdrawal from a distance contract before the balance is used) or another mandatory provision requires it.
  • Not transferable. Kamusaldo belongs to a team. It cannot be transferred to another team, another customer or other users.
  • Expiry. Each Kamusaldo top-up expires 12 months after the date it was added. Expired balance is not refunded or carried over to a new period; the part remaining at the time of expiry is removed.

The Provider regards Kamusaldo as a limited network service within the meaning of section 7 of the Finnish Payment Institutions Act (297/2010) and Article 1(4) of Directive 2009/110/EC of the European Parliament and of the Council. Kamusaldo is not a general-purpose means of payment and not electronic money.

7. Rights and obligations of the customer

The customer is responsible for the content of their site and its lawfulness. The customer undertakes not to publish content that:

  • Infringes copyright or other intellectual property rights
  • Is unlawful, defamatory or offensive
  • Contains malware or endangers information security

The customer is responsible for keeping their user credentials safe.

8. Source code and portability

The customer may request access to the source code of their site at any time. The Provider delivers the source code within a reasonable time of the request.

If the customer wants to move their site to another service, they may copy the source code and receive full rights to it. The Provider does not restrict the customer’s right to freely use, modify or publish the transferred code.

The Kotisivukamu platform itself (base code, dashboard, infrastructure) is the property of the Provider.

9. Data protection and personal data

The Provider processes personal data in accordance with the EU General Data Protection Regulation (GDPR). For data collected through the contact form on the customer’s site, the Provider acts as the processor and the customer as the controller.

More information on how personal data is processed is in our privacy policy.

10. Limitations of liability

The Provider is not liable for:

  • The content of the customer’s site or damage caused by it
  • Disruptions in third-party services (internet connections, domain registries)
  • Interruptions caused by force majeure
  • Indirect damage

The Provider’s liability for damages is limited to the amount of the service fee paid by the customer during the last month.

11. Closing and ending the Service

The Provider has the right to close the site if:

  • The customer materially breaches these terms
  • Payment is more than 30 days late
  • The content of the site breaks the law or these terms

When the agreement ends, the customer may request the source code of their site. The Provider keeps the site data for 30 days after the agreement ends, after which it may be deleted.

12. Governing law and dispute resolution

The agreement is governed by Finnish law. Disputes are primarily resolved by negotiation. If negotiations do not lead to a solution, the dispute is resolved in the Helsinki District Court. A consumer customer may also refer the dispute to the Consumer Disputes Board (www.kuluttajariita.fi).
